TERMS OF SERVICE (Version 1.3; Revised May 31, 2026)
1. Application of the Terms of Service
The present terms of service ("Terms of Service") form the overall basis of the contractual relationship between ServiceUptime and its customers ("Customer(s)") with the aim being the provision of services by ServiceUptime ("the contract" or "the subscription").
Any command or purchase of ServiceUptime' services on this site or in any other form implies prior acceptance of the present Terms of Service. As a consequence, it is assumed that the Customer is fully informed of the fact that their agreement concerning the content of the present Terms of Service does not require the handwritten signature of this document. ServiceUptime may modify the present Terms of Service with prior notice to the Customer. The modified Terms of Service will come into force one month after the notice given to the Customer, except where ServiceUptime has notified of a different date, which can be only after one month.
2. Service request, free service and paying service
To use the services available on the ServiceUptime site, the Customer must create an account by completing the registration application available at the following address: http://www.serviceuptime.com/register.php. An account may be provided under either a free plan or a paid subscription plan. Paid subscriptions may be billed on a monthly or yearly basis, depending on the plan and billing option selected by the Customer at the time of purchase.
The subscription period, price, billing frequency and applicable services are displayed to the Customer before payment is completed. By completing a purchase, the Customer authorizes ServiceUptime to charge the selected payment method for the applicable subscription amount and, unless the subscription is cancelled in accordance with these Terms of Service, to automatically renew the subscription at the end of each applicable billing period.
A paid subscription automatically renews for a new billing period of the same duration as the original subscription unless the Customer cancels the subscription before the next scheduled renewal. Renewal charges are based on the price applicable to the Customer's subscription at the time of renewal, subject to any notice of price changes required under these Terms of Service.
The subscription may be modified or cancelled at any time in accordance with the cancellation procedure described in these Terms of Service. Cancellation prevents future renewal charges but does not, by itself, constitute a request for a refund of any payment already processed.
Customer may register only for one free account. Extra free accounts will be deleted.
As a free user customer agrees to receive occasional newsletters when sign up for free account. Free account remains active while the owner logs in into account at least once in three months. If there is no activity within 3 months free plan account is the subject for de-activation and if no log in activity detected within next 3 months the account may be deleted. In order to access more or all of the services offered by ServiceUptime, the Customer must upgrade their account.
This can be done by using their account configuration which ends with the secured payment.
The minimum pricing of a monthly subscription is fixed at $5.95 (unless there are discounts or special offers). Pricing for yearly subscriptions and other plans is displayed on the ServiceUptime website and at the time of purchase.
If an additional service is required (account extension, frequency and/or media purchase) during the billing period, a pro-rata amount for this service is invoiced to the Customer and is calculated on the time through to the end of the period concerned. If the Customer wishes to reduce their subscription during the billing period (less applications at certain frequencies or less media), a credit is calculated on a pro-rata basis and is credited to the Customer. A credit balance is never reimbursed or credited to the credit card.
This credit is kept on the Customer's account until this credit is entirely used up by future services.
ServiceUptime remains free to decide in the future to end the free service currently offered, and to modify the content therein, with prior information sent to the Customers who have subscribed to it, with no right to this service being granted to the Customer. The obligations and responsibilities of ServiceUptime for the free service are, in accordance with the present Terms of Service, to be different to those of the paying service.
A detailed description of the service offered by ServiceUptime is available on the ServiceUptime site. In case of contradiction between this description and the present Terms of Service, the present Terms of Service take precedence.
3. Subscription Renewal, Automatic Recurring Payments and Cancellation
ServiceUptime offers both monthly and yearly subscription plans. The applicable billing frequency and subscription price are displayed to the Customer before the Customer completes the purchase.
Unless otherwise expressly stated at the time of purchase, a paid subscription is an automatically renewing subscription. By completing the purchase, the Customer authorizes ServiceUptime to automatically charge the payment method on file for each subsequent billing period at the then-applicable subscription price, unless the subscription has been cancelled before the next renewal date.
For yearly subscriptions, the subscription automatically renews for another one-year period on the applicable annual renewal date. For monthly subscriptions, the subscription automatically renews for another one-month period on the applicable monthly renewal date.
The Customer may cancel the subscription at any time before the next renewal date by using the cancellation functionality available in the Customer Account or by submitting a cancellation request through the ServiceUptime contact form.
Cancellation takes effect according to the cancellation option selected or the applicable cancellation procedure and prevents future recurring charges after the cancellation has been processed. A Customer who does not cancel the subscription before the applicable renewal date authorizes ServiceUptime to process the recurring payment for the next billing period.
The Customer is responsible for cancelling the subscription if they no longer wish to use the ServiceUptime service. Failure to use the service, failure to log into the Customer Account, or failure to receive or review billing notifications does not by itself constitute cancellation of the subscription.
ServiceUptime does not consider a subscription cancelled unless a cancellation has been successfully submitted through one of the available cancellation methods. Customers are encouraged to retain the cancellation confirmation for their records.
If a Customer requests cancellation or a refund through the contact form, the request will be reviewed and processed in accordance with the Refund Policy set out below.
Renewal Notifications
Where applicable, ServiceUptime may send a reminder or notification regarding an upcoming subscription renewal to the email address associated with the Customer Account. The Customer is responsible for keeping the email address associated with the account current and for ensuring that emails from ServiceUptime can be received.
The absence or non-receipt of a renewal notification does not cancel an otherwise valid subscription or prevent an automatic renewal where the Customer has previously authorized recurring billing and has not cancelled the subscription.
4. Refund and Cancellation Policy
ServiceUptime provides refunds in accordance with the terms set out below. By purchasing a ServiceUptime subscription, the Customer acknowledges and agrees to this Refund and Cancellation Policy.
Cancellation
The Customer may cancel their subscription at any time before the next scheduled renewal date.
A subscription can be cancelled using either of the following methods:
Through the Customer Account by selecting Account → Settings → Cancellation → Cancel Subscription; or
By submitting a cancellation request through the ServiceUptime contact form.
A subscription is considered cancelled only when the cancellation has been successfully submitted through one of the methods described above.
Simply discontinuing use of the ServiceUptime service, not logging into the Customer Account, or allowing a subscription to remain unused does not constitute cancellation.
If the Customer does not cancel the subscription before the applicable renewal date, the subscription will automatically renew and the payment for the next subscription period will be charged in accordance with the recurring billing authorization previously provided by the Customer.
Refunds
Refund eligibility depends on the type of subscription and the time elapsed since the applicable payment.
For an initial subscription purchase, the Customer may request a refund within 30 days of the original payment, subject to the applicable refund conditions.
For an annual subscription renewal, the Customer may request a refund within 60 days of the renewal payment. Where a refund is granted for an annual subscription, the refund amount may be calculated on a pro-rata basis based on the unused portion of the subscription period.
Refund requests must be submitted through the ServiceUptime contact form.
ServiceUptime will review each refund request in accordance with this policy. Approved refunds are normally processed within 24 hours after the refund request has been reviewed and approved. The time required for the refunded amount to appear on the Customer's card or bank account may depend on the Customer's payment provider or financial institution.
After the applicable refund period has expired, payments are generally non-refundable, except where required by applicable law or where ServiceUptime expressly determines otherwise.
Cancellation Does Not Automatically Constitute a Refund
Cancellation of a subscription prevents future renewal charges but does not, by itself, create a right to a refund for a payment that has already been processed.
If a Customer wishes to request a refund for a payment that has already been processed, the Customer must separately submit a refund request through the ServiceUptime contact form and provide the information reasonably necessary to identify the applicable transaction.
Chargebacks and Refund Requests
Customers agree to contact ServiceUptime and use the refund procedure described above before initiating a payment dispute or chargeback with their card issuer for a transaction that is subject to this Refund and Cancellation Policy.
If a Customer believes that a payment was made in error or that they are entitled to a refund, ServiceUptime will review the matter promptly upon receiving a refund request.
Initiating a chargeback does not constitute a cancellation of a subscription. A subscription remains active until it has been cancelled through one of the cancellation methods described above, unless ServiceUptime determines otherwise.
Nothing in this policy limits any rights or remedies that cannot legally be excluded or restricted under applicable law.
5. Payment, transaction security and invoicing
The payment is payable as soon as the command is made. The Customer's command becomes firm as soon as the Customer validates their command after having entered the number and expiry date from their payment card.
To ensure the security of all transactions processed through our website, ServiceUptime uses industry-standard security measures and encrypted connections. Payment information is transmitted using secure SSL/TLS encryption and is processed through trusted, PCI-compliant payment infrastructure. ServiceUptime does not store or have direct access to your full payment card details.
Furthermore, ServiceUptime does not store the information concerning the Customer's payment card and retains only the information concerning the Customer's command to deal with its processing and tracking and to inform the Customer of its product/services offers.
ServiceUptime reserves itself the option of modifying (upwards or downwards) the subscription prices offered subject to advising the Customer about it in advance. In this case, the subscriptions in place will be maintained at the price in force at the time, the modifications only taking effect from the day following the last day of the subscription (the anniversary of the month following); in this case, the Customer will be able to end the subscription following the procedure before the date of the new price coming into effect. At the end of each applicable billing period, ServiceUptime automatically charges the subscription amount to the Customer's payment method in accordance with the billing frequency selected by the Customer. ServiceUptime reserves itself the right to terminate the service if the latter is not paid for.
6. Customer obligations
The Customer promises that for the applications checked by ServiceUptime through their account, they are the legal owner or the rights holder, or that they have obtained authorisation from the legal owner and are entitled to order the services at ServiceUptime. They guarantee ServiceUptime against any claim from third parties who claim that ServiceUptime' services on such applications have not been requested or have disrupted their activities. The Customer guarantees that all the data and/or documents provided are correct. The Customer is allowed to have only one free account and agrees to that rule. All extra accounts should be upgraded to premium or cancelled.
7. ServiceUptime' obligations
ServiceUptime promises to take all reasonable care for executing this Contract. ServiceUptime promises to do its best to provide a quality service, as part of due care ("best efforts").
8. Applicable law, appeal and disputes
Access to and use of the ServiceUptime site are governed exclusively by US law, subject to the application of mandatory provisions applicable to consumers. Any disputes arising from the Contract will be subject exclusively to the jurisdiction of the courts in OC, US.
9. Intellectual property rights
All of the intellectual property rights on the service, tools used, web site, technology, software, and know-how developed by ServiceUptime are and remain their exclusive property. The reproduction or use of the textual and multimedia data (sound, images, software, etc.) of ServiceUptime or of its website, are subject to prior authorisation on the part of ServiceUptime. Without authorisation, any reproduction or use is prohibited. The name "ServiceUptime" is protected for its trade name or commercial name. The Customer has no right or licence on the elements which are the property of ServiceUptime.
10. DISCLAIMER OF WARRANTY
SERVICEUPTIME DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, INFORMATIONAL CONTENT, OR NONINFRINGEMENT. IN NO EVENT SHALL SERVICEUPTIME BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF DATA, USE, PROFITS, OR OPPORTUNITY, AND THE COSTS OF SUBSTITUTE SERVICE OR DAMAGES RESULTING FROM A THIRD PARTY'S UNAUTHORIZED USE) RELATED TO, OR ARISING FROM, USE, MISUSE, OR INABILITY TO USE THE SERVICE, REGARDLESS OF WHETHER OR NOT THE PROVIDER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. THE FOREGOING LIMITATION APPLIES TO CLAIMS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), LIABILITY, OR ANY OTHER LEGAL THEORY. SOME JURISDICTIONS DO NOT ALLOW LIMITING LIABILITY FOR CERTAIN DAMAGES. IN SUCH JURISDICTIONS, SERVICEUPTIME' LIABILITY SHALL BE LIMITED TO THE EXTENT PERMITTED UNDER LAW.
